At LUSILECTRA – VEÍCULOS E EQUIPAMENTOS, S.A.  (“LUSILECTRA”) we recognize the importance of your personal data processing and we are committed in protecting data security and privacy.

In this context, we present LUSILECTRA’s privacy policy, which explains what personal data we collect, for what purposes we can use it, how we process it, with whom we share it, for how long we keep it, as well as how to contact us and exercise your rights.

WHO IS THE RESPONSIBLE FOR PERSONAL DATA PROCESSING?

LUSILECTRA – VEÍCULOS E EQUIPAMENTOS, S.A., a public limited company under the Portuguese Law, registered at the Commercial Registry of Porto, legal person number 501 381 430, with headquarters on Rua Eng.º Ferreira Dias, nº 993, 4100-247 Porto (Portugal) is the responsible entity for the personal data processing, through automated means or not, from its collection, organization, conservation to disposal.

WHAT PERSONAL DATA DO WE COLLECT?

LUSILECTRA only collects and processes personal data which are directly supplied by you, whether through any contact form filling or through the acquisition of a product or service, that will be in general the following, as the case may be:

Data category	Examples
Identification data	Name, civil identification document number and expiration date, identification data contained in companies’ permanent certificates (and respective images).
Contact data	Address, mobile number, e-mail.
Data concerning professional status	Occupation, professional status.
Data concerning personal status	Date of birth, civil status, household.
Transaction data	Proof of transaction, quantities, prices and other transaction elements and conditions.
Financial and bank details	Information concerning the economic situation of the data holder (IRS or IRC declaration, pay slip)
Customer history data	Customer number, contract number and other categories that must be kept within the scope of the historical archive of the data holder.
Platform usage data	Answers to satisfaction surveys, order date, deadline of the contract, price, complaints history.
Data on the status and use of equipment and vehicles	Kilometres, number of hours, periodic assistance reports, maintenance and repairs registration, driving data with speed, breakdowns and events information.
Application, Internet and Social network data	Location, use of LUSILECTRA’s social networks.

FOR WHAT PURPOSES DO WE PROCESS YOUR PERSONAL DATA?

At LUSILECTRA we process your personal data for the following purposes:

Customer management, execution and fulfilment of our pre-contractual and contractual obligations.	– To answer to your requests and contract requests. – To assure the scheduling of services and repairs. – Execution of contractual guarantee.
Communicate and manage our relationship with you	– To contact with you for administrative and/or operations reasons, assuring that we manage properly your relationship with us, and we solve your requests. – Recording and/or registration of calls to monitor service quality.
Customize and improve your customer experience	– To contact you to perform Satisfaction Surveys about our services.  We have a legitimate interest on your personal data processing for this purpose, which we believe to be also advantageous to you as it allows us to better serve and assure you the greatest possible satisfaction as our customer. You can at any time, inform us that you no longer wish to be contacted for these purposes.
Marketing	– In case you are our customer, we will use your personal data to send you news from us, such as, new offers, new campaigns and services from LUSILECTRA that you might like to receive. We have a legitimate interest on sending you this information, since it will be also advantageous for you, allowing to improve your experience and to have access to information that we believe is of your full interest. – In case you are not yet our customer, we will use your personal data to inform you about offers you might like, only if you have given us your express consent for that purpose, for example, when you subscribe a form to receive marketing communication from Lusilectra, namely promotions, events and new products by e-mail, or when you fulfil a contact form and you select the option.   For these purposes, we can also analyse your user profile, specially through your navigation history and /or purchases history in order to determine what are your preferences and thus, to send you customized information. At no time will we share your personal data with third parties for marketing purposes, except in case we have your express and explicit consent.   If you do not wish to receive marketing communication from us, you can inform us at any time, by clicking on the unsubscribe link at the bottom of any marketing e-mail received LUSILECTRA. We meet our legal obligations	– To provide you with assistance within the scope of the legal and/or contractual warranty and for carrying out technical campaigns aimed at your safety and safety of the products and/or services supplied to you by LUSILECTRA, as well as other legal obligations that can of our responsibility. – Answer to judicial, regulatory and supervisory bodies.
Manage your registration as a user	– In case you perform the registration as an application user, on a reserved area or on a platform owned or under management by LUSILECTRA, we need to process you data in order to identify you as a user on such platforms and to give you access to the various functionalities, products and services available as a registered user.
Control of the physical safety	– Video surveillance on the premises.
Litigation management	– Judicial and extrajudicial collection. – Management of other conflicts.
Accounting, Tax and Administrative management	– Accounting, invoicing. – Commissions management. – Tax information, including sending of information to the tax authority.

DO WE SHARE YOUR DATA WITH THIRD PARTIES?

In order to guarantee the proper follow-up to your requests, as well as assure the best possible service, your personal data can be shared with parties that supply us support or service, suppliers, public authorities, for example:  

• Importing companies and/or equipment, components, truck lift or tools manufacturers that might be purchased, object of services provision, that was tested or in which it showed interest.
• Technological service providers,
• Service providers related with customer support.
• Public authorities (for example Tax and Customs Authority)
• Financial institutions, if within the scope of the business and/or transaction we enter with you, this is necessary under the terms requested by you.

We inform that LUSILECTRA has as a subcontractor for data processing purposes the following entity:

• RIGOR – CONSULTORIA E GESTÃO, S.A (public limited company under the Portuguese Law, registered at the Commercial registry Office of Vila Nova de Gaia, legal person number 502 055 235).

LUSILECTRA guarantees that such entities are also equipped with technical and organizational measures to guarantee the total protection of your personal data and that these data will only be processed to fully comply with the purposes inherent to the execution of the contract.

We also inform that in some circumstances, LUSILECTRA act as a subcontractor, especially when an agent of our Distributors and Resellers network provides personal data from their customers in order that LUSILECTRA can send the ordered products.

Note that in these cases the agent to whom the customer provided his/her personal data, is responsible for data processing.

HOW DO WE PROCESS YOUR PERSONAL DATA AND FOR HOW LONG DO WE KEEP THEM?

We have implemented technical and organizational measures to protect your personal data against destruction, accidental or unlawful, accidental loss, modification, disclosure or unauthorized access to these data.

The period of retention of your personal data will depend on the purposes for which we process it, i.e., we process you data for as long as it is strictly necessary to fulfil de purpose and, eventually, we keep the data afterwards, properly saved and protected during the period where it might arise responsibilities due to the processing, namely within the scope of compliance with the legislation in force at each time.

Having given your consent for the purpose of receiving our marketing communication, your personal data will be kept for 2 years.

The above mentioned term may be extended due to reasons related to compliance of legal obligations.

WHAT ARE THE RIGHTS OF DATA HOLDERS?

You have the right, whenever you want and free of charge, to ask LUSILECTRA to:

• Access to your personal data
• Correct of your personal data
• Delete your personal data  
• Limit your personal data processing
• Oppose to your personal data processing
• Request the portability of your personal data to the entity indicated by you.

Please note that in case it exists a standard or obligation legally imposed that overrides these rights, LUSILECTRA will respond to the impossibility to execute the request, indicating the correspondent reasons.
