At LUSILECTRA – VEÍCULOS E EQUIPAMENTOS, S.A. (“LUSILECTRA”) we recognise the importance of processing your personal data and are committed to protecting its security and privacy.

In this context, we present LUSILECTRA’s privacy policy, which explains what personal data we collect, for what purposes we may use it, how we process it, with whom we share it, how long we keep it, and how you can contact us and exercise your rights.

Who is the controller of personal data?

LUSILECTRA – VEÍCULOS E EQUIPAMENTOS, S.A., a public limited company incorporated under Portuguese law, registered at the Porto Commercial Registry Office, legal entity number 501 381 430, with registered office at Rua Eng.º Ferreira Dias, nº 993, 4100-247 Porto (Portugal), is the entity responsible for processing personal data, whether by automated means or not, from its collection, organisation and storage through to its erasure.

What personal data do we collect?

LUSILECTRA only collects and processes personal data provided directly by you, whether by filling in a contact form or by purchasing a product or service. Depending on the case, this will generally include the following:

Identification data	Name, number and expiry date of civil identification document, identification data contained in companies’ permanent registry certificates (and respective images).
Contact data	Address, mobile phone, e-mail.
Professional status data	Occupation, professional status.
Personal status data	Date of birth, marital status, household.
Transaction data	Proof of transaction, quantities, prices and other elements and conditions of the transaction.
Financial and banking data	Data relating to the economic situation of the data subject (personal or corporate income tax return, payslip).
Customer history data	Customer number, contract number and data from the other categories that must be kept as part of the data subject’s historical record.
Platform usage data	Responses to satisfaction surveys, order date, contract term, price, complaints history.
Data on the condition and use of equipment and vehicles	Mileage, operating hours, periodic service reports, maintenance and intervention records, driving data including speed, faults and events.
Application, internet and social media data	Location, use of LUSILECTRA’s social media.

For what purposes do we process your personal data?

At LUSILECTRA we process personal data for the following purposes:

Communicating and managing our relationship with you	– Contacting you for administrative and/or operational reasons, ensuring that we manage our relationship with you properly and resolve your request. – Recording and/or logging calls to monitor service quality.
Personalising and improving your customer experience	– Contacting you to carry out satisfaction surveys about our services. We consider that we have a legitimate interest in processing your personal data for this purpose, which we believe also benefits you, as it allows us to serve you better and ensure the greatest possible satisfaction as our customer. You may inform us at any time that you no longer wish to be contacted for this purpose.
Marketing	– If you are our customer, we will use your personal data to send you news about LUSILECTRA, such as new offers, campaigns, products and services you may like. We consider that we have a legitimate interest in sending this information, as it also benefits you by improving your experience and giving you access to information we believe is of interest to you. – If you are not yet our customer, we will only use your personal data to inform you of offers you may like where you have given us your express consent, for example when you subscribe to receive marketing communications from Lusilectra (promotions, events and new products by e-mail) or when you fill in a contact form and tick that option. For these purposes, we may also analyse your user or customer profile, namely your browsing and/or purchase history, to determine your preferences and send you personalised information. We will never share your personal data with third parties for marketing purposes without your express and explicit consent. If you do not wish to receive marketing communications from us, you can tell us at any time by clicking the unsubscribe link at the bottom of any marketing e-mail from LUSILECTRA or by writing to qualidade@lusilectra.pt.
Complying with our legal obligations	– Providing assistance under the legal and/or contractual warranty and carrying out technical campaigns aimed at your safety and the safety of the products and/or services supplied to you by LUSILECTRA, as well as other legal obligations incumbent on us. – Responding to judicial, regulatory and supervisory authorities.
Managing your user registration	– If you register as a user of an app, reserved area or platform owned or managed by LUSILECTRA, we need to process your data to identify you as a user of such platforms and give you access to the features, products and services available to registered users.
Physical security	– Video surveillance of the premises.
Litigation management	– Judicial and out-of-court debt collection. – Management of other disputes.
Accounting, tax and administrative management	– Accounting, invoicing. – Commission management. – Tax reporting, including submission of information to the tax authority.

Do we share your data with third parties?

In order to follow up on your requests and provide you with the best possible assistance, your personal data may be shared with entities that provide us with support or services, suppliers and public authorities, for example:

• Importers and/or manufacturers of the brand of equipment, accessory, forklift truck or tool purchased, serviced, tested or in which you expressed interest.
• Technology service providers.
• Customer support service providers.
• Public authorities (e.g. the Portuguese Tax and Customs Authority).
• Financial institutions, where necessary for the business and/or transaction we carry out with you, under the terms you requested.

We hereby inform you that LUSILECTRA uses the following entity as a processor:

• NiW – IT SERVICES AND CONSULTING, S.A. (public limited company incorporated under Portuguese law, registered at the Vila Nova de Gaia Commercial Registry Office, legal entity number 502 055 235).

LUSILECTRA ensures that such entities also have technical and organisational measures in place to guarantee the full protection of your personal data and that they will only process it to fully achieve the purposes inherent to the performance of the contract.

We also inform you that in some situations LUSILECTRA acts as a processor, namely when an agent from its network of authorised distributors and resellers provides the personal data of its customers so that LUSILECTRA can ship the ordered products to them.

Please note that in these cases the agent to whom the customer provided their personal data is the controller of that data.

How do we process your data and how long do we keep it?

We have implemented technical and organisational measures to protect your personal data against accidental or unlawful destruction, accidental loss, alteration, disclosure or unauthorised access.

The retention period depends on the purposes for which we process your data: we process it for as long as strictly necessary to fulfil the corresponding purpose and may subsequently keep it, duly stored and protected, for as long as liabilities may arise from the processing, namely in compliance with the legislation in force at any given time.

If you have given your consent to receive our marketing communications, your data will be kept for 2 years.

This period may be extended for reasons related to compliance with legal obligations.

What are the rights of data subjects?

You have the right, at any time and free of charge, to ask LUSILECTRA to:

• Access the data you provided to us
• Rectify your data
• Erase your data
• Restrict the processing of your data
• Object to the processing of your data
• Transfer your data to an entity of your choice (data portability).

You may exercise these rights by sending an e-mail to qualidade@lusilectra.pt or a letter to Rua Eng.º Ferreira Dias, 953/993 | 4100-247 Porto – Portugal.

However, if a legal provision or obligation overrides these rights, LUSILECTRA will reply stating that the request cannot be fulfilled and giving the corresponding grounds.

How to make a complaint

LUSILECTRA reserves the right to modify or update this Privacy Policy at any time; any such changes will be duly published on this platform.
